Will this lease pass review?
Before a HAP contract can be signed, someone has to read the lease. This page walks the review the way the regulation is organized: is the unit even an eligible type, does the lease say everything 982.308(b) requires, does it contain anything 982.308(d) prohibits, and does the term math under 982.309 work — then it writes the review memo for the file.
Step 1 — Eligible unit screen
24 CFR 982.352. Check any category that describes this unit — one check and the review stops here, no matter how good the lease is.
Step 2 — Required lease terms
24 CFR 982.308(b). The lease must be written, executed, and must specify each of these. The tenancy addendum must be the HUD form word-for-word.
Step 3 — Prohibited-provision scan
24 CFR 982.308(d). Check any clause you find in the proposed lease — each one must come out (or is overridden by the addendum) before approval.
Step 4 — Term & timing math
24 CFR 982.309. Initial term at least one year (a shorter term needs a specific PHA determination); the HAP contract runs first day to last day of the lease term; and the rent to owner cannot step up during the initial term (form HUD-52641, Part A).
